Terms and Conditions of Sale

Transactions between Jeinstein.com and the prurchaser, or "client", are governed exclusively by these Terms and Conditions of Sale, subject to current Chilean Law, with particular refernce to the Chilean Civil and Commercial Codes.

If the client does not accept these conditions, he should not make any purchase of goods or services in the Jeinstein.com web site.

By effecting a transaction or participating in the web site, the client indicates that he accepts aand recognizes the validity of the conditions set by Jeinstein.com in the Terms and Conditions of Sale.

Prices

The prices published on the Jeinstein.com web site are expressed in US Dollars, and for purchases within Chile may be converted into Chilean pesos at a rate of exchange which will be updated periodically. All the published prices include 18% Value Added Tax (VAT) established by the Chilean Internal revenue Service, in addition to the price of the product. The conversion rate published on the web page at the time of the purchase will be honoured.

Jeinstein.com accepts no responsibility for any customs charges imposed on shipments despatched to foreign countries, which may increase the final cost of the product.

Jeinstein.com reserves the right to change prices and/or products without prior warning to the clients. Where an order has already been placed or a purchase effected, Jeinstein.com will honour the information published at the time when the transaction was made.

Promotional offers published on any product will remain valid as stipulated, and will be marked and identified as such.

Purchase Order

Orders will be initiated by the submission by the client of a request made on a "purchase order" form, which will contain the following information: identification of product; number ordered; client information; delivery address; etc.

The submission of this purchase order by the client implies a declaration by him that the order is valid, in other words it implies a willingness to form a contract with Jeinstein.com. All orders are subject to their acceptance by Jeinstein.com.

Every order will be assigned an indentifier number known as the "purchase order number".

Payment and Despatch

Goods ordered from Jeinstein.com will be despatched once payment has been confirmed.

Payment may be made by any internationally accepted credit card; Visa, Master Card, Diner's Club Internacional and Magna subject to on-line authorization through Transbank's "Webpay" system.

The charge to your credit card will be for the total cost of the order, including shipping costs.

In this web site, Jeinstein.com offers you the possibility of paying in interest-free quotas through Transbank. These operations may only be effetced on credit cards issued in Chile, in Chilean pesos, with a maximum of three interest-free monthly quotas.

Purchases by the "Redcompra" system (only available in Chile) are also authorized by Transbank.

The "WebPay" service used by Jeinstein.com to proccess credit card payments, is a service provided by Transbank, and this system will check and authorize or reject the charge, depending on the state of your credit card account.

If the credit card is not valid or is rejected by the "Webpay" on-line payment system, the client will be informed immediately via a specially designed web page, which simply state that the transaction has been rejected without any further details.

"WebPay" incorporates key security elements: encryptation of data which are transmitted over the net with the SSL (Secure Socket Layer) security protocol, validation of additional data (verification code), business authentication, and handling of credit card information.

Jeinstein.com only receives approval or rejection of a transaction from "WebPay", and is not informed under any circumstances of specific information relating to your credit card.

In the case of transactions effected in Chile, it is possible to purchase on a Cash On Delivery (COD) basis, offered by LanCourier; the client makes the pruchase through Jeinstein.com and pays the total cost and shipping charges on receipt of the product, by cash or cheque.

Jeinstein.com accepts no liability for delays occurring in the delivery of goods, which are the responsibility of the courier services: LanCourier within Chile and DHL International for despatches abroad. A delay will not signify the cancellation of the purchase order, nor the payment of any indemnity by Jeinstein.com.

A table of shipping charges will be published on the Jeinstein.com web site, including the name of the carrier and the shipping costs to final destination. This cost will be paid in advance by the client, together with the cost of the goods purchased through the web site, and will be calculated immediately by the system based on the delivery address and the weight and dimensions of the product, and the cost added to the total cost of the purchase.

Dates of delivery and despatch are fixed by the courier services (LanCourier y DHL internacional) and are beyond the control of Jeinstein.com. In the case of Lancourier, the maximum delivery date is 4 working days. In the case of DHL international courier, the maximum delivery date is 10 working days.

The tariffs published by LanCourier for the transport of goods do not include Value Added Tax (VAT) and are adjusted every six months according to variations in the Retail Price Index (RPI).

DHL Internacional prices are published in US$ and are not subject to VAT. These tariffs do not include customs duties, taxes, tariffs or other charges on the import of goods. The transit times indicated by DHL Internacional do not allow for possible delays which shipments may suffer due to customs inspections in the destination country. Transit times are given in working days, i.e. exclude weekends and public holidays.

Warranties and Returned Goods

Jeinstein.com guarantees that their products are free of defects.

The degree of difficulty classifications which Jeinstein.com has established for its puzzles, will not be accepted as justification for claims or the return of goods, since they have been designed according to general puzzle-solving criteria.

The return of goods which have any defect on receipt will be accepted.

On receiving the oods, the client should check immediately that the product is in perfect condition. If no claim has been sent by the client by e-mail within 48 hours of receipt of the goods, they will be deemed to have been received satisfactorily.

Return of goods will only be accepted within 30 days of the receipt of the product and after a written claim stating the reasons for return has been submitted by the client. Shipping costs shall be for the account of the client, and the goods should be despatched by the same service which effected the delivery (LanCourier or DHL Internacional). The product will be inspected, and only if it is indeed found to be defective will Jeinstein.com reimburse the shipping costs incurred by the client as indicated above. If the client prefers to cancel the order of a defective product, the same process mentioned above will be carried out (i.e. reimbursement of shipping costs), the purchase will be cancelled and the total price credited to the clients credit card account through Transbank.

The purchaser must not incur any violation or infraction of the 'US Export Administration Regulations', or any other regulation which may be applicable, with respect to the products or technical information on the products. It is the purchaser's responsibility be to informed about such infractions and their consequences; Jeinstein.com accepts no responsibility in this respect.

Jeinstein.com reserves the right to modify any information contained in this web site, including that referring to goods, services, prices, stock, and conditions, at any moment and without prior warning.
